By accessing and using Eye Catching Jobs (the "Platform"), you agree to comply with and be bound by these terms and conditions. If you do not agree with any part of these terms and conditions and/or any of Eye Catching Job’s Privacy Policies, you are not authorized to access or use the Platform.

You are granted authorization by Eye Catching Jobs to access and utilize the information on the Platform, exclusively for personal, non-commercial use, provided you are at least 18 years of age. The information and materials presented on the Platform may not be reproduced, transmitted, displayed, distributed, downloaded, licensed, modified, published, posted, replicated, utilized, sold, transmitted, utilized to generate a derivative work, or otherwise employed for commercial or public purposes without the express prior written consent of Eye Catching Jobs.

Engaging in data mining, the use of robots, or similar data gathering or extraction tools or processes in connection with the Platform, as well as any reproduction or circumvention of the navigational structure or presentation of the Platform or its content, is strictly prohibited. You pledge not to employ the Platform for any unlawful purpose.

To access the Platform, registration is mandatory. By providing a telephone number, you consent to receiving calls or texts at that number, whether manually or automatically dialed, from Eye Catching Jobs and/or participating vendors. If you provide an email address, you also consent to receiving electronic communication, including commercial electronic messages, from Eye Catching Jobs or participating vendors. Opting out or unsubscribing is an option if you do not wish to receive calls, texts, or electronic messages. You can exercise this option by emailing info@eyecatchingjobs.com.

Ensuring the confidentiality of passwords and accounts is your responsibility, and you are entirely accountable for all activities under such passwords or accounts. Notify Eye Catching Jobs promptly in writing if you detect any unauthorized use of the password or account or any other security breach. Logging out at the conclusion of each session is mandatory. Eye Catching Jobs holds no liability for any loss or damage resulting from your failure to adhere to these Terms and Conditions.

Agreeing not to alter the Platform or use modified versions (except if modified by Eye Catching Jobs), especially for unauthorized access, is a condition. You also pledge not to access the Platform through any means other than the interface provided by Eye Catching Jobs for accessing the Platform.

2. User Registration

To access certain features of the Platform, you may be required to register an account. You agree to provide accurate and complete information during the registration process and to update such information to keep it current.

3. License Sharing Prohibition Clause

3. Unauthorized Sharing: Any attempt to share, sublicense, or otherwise allow a third party to use a license without explicit written consent from Eye Catching Jobs constitutes a material breach of these terms and may result in the immediate termination of the user's account and legal action.
   
2. Monitoring and Enforcement
   
1. Monitoring: Eye Catching Jobs reserves the right to monitor user accounts and usage patterns to detect and prevent unauthorized sharing of licenses.
   
2. Enforcement: In the event of a violation of the license sharing prohibition, Eye Catching Jobs may take appropriate legal action and seek damages, injunctive relief, or any other available remedy.
   
3. Reporting Violations
   
1. User Obligation: Users agree to promptly report any suspected or actual instances of license sharing to Eye Catching Jobs.
   
2. Investigation: Eye Catching Jobs will investigate reports of license sharing and take appropriate action based on the findings.
   
4. Exceptions
   
1. Authorized Transfers: Any transfer or assignment of licenses must be expressly authorized by Eye Catching Jobs in writing.
   
2. Corporate Accounts: For corporate accounts or multiple-user licenses, specific terms and conditions regarding user allocation and sharing may be outlined in a separate agreement between Eye Catching Jobs and the corporate entity.
   
5. Termination of Access
   
1. Breach Consequences: Violation of this license sharing prohibition may result in the immediate termination of user access to Eye Catching Jobs, and the user may be held liable for any resulting damages.
   

4. Job Listings and Applications

a. Employers posting job listings must provide accurate and non-discriminatory information.

b. Job seekers are responsible for the accuracy of the information provided in their profiles and applications.

5. Paid Subscriptions - Practices

Eye Catching Jobs offers premium profile subscriptions for eyecare practices, providing enhanced features and visibility on our platform. Practices can choose between two subscription options: monthly or yearly. By subscribing to a premium profile on Eye Catching Jobs, practices agree to the terms of the subscription model outlined below.

1. Monthly Subscription:
   
1. Practices opting for the monthly subscription will be charged a recurring monthly fee for access to the premium profile features. The monthly subscription fee will be automatically charged on a monthly basis until the practice chooses to cancel. To cancel the monthly subscription, practices must notify Eye Catching Jobs by emailing info@eyecatchingjobs.com at least one week before their next monthly renewal date.
   
2. Yearly Subscription:
   
1. Practices opting for the yearly subscription will be charged a one-time upfront fee for a 12-month subscription period. Upon the expiration of the 12-month period, the yearly subscription will automatically renew into a monthly subscription. To cancel the yearly subscription or prevent the auto-renewal into a monthly subscription, practices must notify Eye Catching Jobs by emailing info@eyecatchingjobs.com at least one week before the end of the subscription period or at least one week before their next monthly renewal date.
   

6. Privacy

a. Our Privacy Policy outlines how we collect, use, and protect your personal information. By using the Platform, you consent to the practices described in the Privacy Policy.

7. Content Ownership

a. Eye Catching Jobs does not claim ownership of any content you submit. However, by submitting content (e.g., job listings, resumes), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content. 8. Prohibited Conduct

a. Users must not engage in illegal or unauthorized activities on the Platform.

b. Posting misleading, fraudulent, or inappropriate content is strictly prohibited.

9. Content Standards and Removal Rights

Eye Catching Jobs reserves the right to review, remove, or reject any content submitted for display on our platform that does not meet our standards or expectations. This includes but is not limited to:

1. Content that violates our terms of service, including prohibited content such as illegal or discriminatory material.
2. Content that is inaccurate, misleading, or outdated.
3. Content that does not adhere to our community guidelines or standards of professionalism.
4. Content that may harm the reputation or integrity of Eye Catching Jobs or its users.
5. Content that competes with or violates Eye Catching Jobs services & features.

Eye Catching Jobs will make reasonable efforts to notify the user responsible for the content in question and provide an opportunity to address any concerns or issues. However, we reserve the right to remove or reject content without prior notice if deemed necessary to maintain the quality and integrity of our platform.

10. Third-Party Links

a. The Platform may contain links to third-party websites. Eye Catching Jobs is not responsible for the content or practices of these websites.

11. Termination

a. Eye Catching Jobs reserves the right to suspend or terminate your account if you violate these terms or engage in activities that are harmful to the Platform or other users.

12. Unauthorized Access and Denial of Access:

Eye Catching Jobs reserves the right to deny access to the Platform and its services to any individual or entity attempting to gain unauthorized access to our systems, servers, or any part of the Platform. Unauthorized access includes, but is not limited to, attempts to breach security measures, manipulate the Platform's code, or access areas of the Platform not explicitly intended for public use.

Any such attempts may result in the immediate denial of access, and Eye Catching Jobs may take appropriate legal action as deemed necessary. This clause applies to individuals or entities who are not part of the intended audience or who violate the terms and conditions outlined herein.

By accessing and using the Platform, you agree to refrain from any unauthorized attempts to access or manipulate the system. Eye Catching Jobs is committed to maintaining the security and integrity of its Platform and will take necessary measures to protect against unauthorized access.
